Bill vs Hentai close to becoming law in the Philippines.

So. How long will this last before they realize this is unenforceable? I mean, they can't stop people from selling REAL child porn on street side stalls, how the hell are they going to stop the hentai?

It's enforcability is not the issue. People still get away with murder these days; the existence of a law does not imply that such acts will be stopped.

What this would do, on the other hand, is prosecute the people who do matter. You are found distributing hentai on the streets? You now go to jail, rather than just have your goods confiscated. Selling inside a mall? The establishment owner can get arrested for that now (directly).

That said, I don't think stopping hentai is a way to stop child pornography. To declare the bill as a way to oppose the latter is stupid. I mean, I strongly oppose child pornography. I hate it. But hentai=/=child pornography. Sure, something may qualify as both, but to say that they are one and the same... that person needs more research.

Don't forget, the proposed law also makes possession of digital copies illegal. So, if, say, they start seizing CPUs and find loli hentai there, then they could arrest the owner, right?

Well, the proposed law says any hentai. Which means that EVERY FRICKIN' PERSON IN THE PHILIPPINES can get prosecuted.

I exaggerate, but you know what I mean. I remember the good times I had watching hentai with my classmates during their birthdays. *reminiscing* All of those will go away just because of some stupid law made/passed by stupid legislators.

Yes. Child pornography, even when represented by anime, is a horrible thing, and if you have it in your hard drive intentionally, then you deserve to go to prison.

BUT, the only way authorities can actually do that is by a) raiding the place with the CPU in question, or b) if they have a search warrant.

a) is impractical unless you have good reason to believe that you are caught in the act. Besides, if the authorities do that and find nothing, then the Writ of Habeas Corpus says that you can kick their @ss in court.

b) is impractical to do on the common sick pervert with loli hentai on his hard drive. Securing one warrant takes a lot of time in our government, and it'll likely cost some money, too. The only person who actually needs to worry about this is someone who is so bad, the government has a need to imprison him/her.

In truth, the common tiwsted pervert does not have anything to worry (no matter how much I think they should); if they can arrest anyone for something in their CPU's, then I believe more people will go to jail because of pirated software than because of hentai.

I will not make any comment on your admitted exaggeration, but i will call BS on your 2nd statement. Is the law stupid? Probably; but that is not a basis to call legislators stupid. More likely, they are old dogs who are trying and failing to understand something new to them.

I trust their heart is in the right place, because the desire to stop child pornography and by extension child prostitution is noble. Unfortunately, they have the impression that all hentai promote such depraved acts.

If you put it that way, you might be right. But what irks me is their lack of research, or if they even research, their failure in identifying fact from misinformation.

This is like banning violent games like GTA. I play GTA therefore I will shoot people on the street for their money. I have loli-H in my hard-drive therefore I am a pedro.

You make an interesting analogy, oghma. Unfortunately, I don't think the two cases are the same.

Here's how I see it. The banning of violent games is insane, because it assumes that killing in games=killing for real. But while not all people who play violent games kill for real, the fact of the matter is that some do. And to make things worse, these same people openly admit that it was video games that inspired them to do it.

So is it a good idea to ban violent video games? Restricting would be better than an outright ban, IMO. Make the games R-18; if some shmuck of a kid buys it, plays it, and gets inspired to get into a shooting spree, it's not the game's fault. It's the fault of the parents for ignoring the restriction, or the fault of his environment for shunning him, or the fault of the sucker who gave him access to guns. Or we might just cut the crap and say that it's the kid's own insanity that did it.

But back on topic, would the same be true for loli hentai? Now here is where we diverge. A violent video game is meant to be just that; a game. Irregardless of the inspiration it brings some sick people, the majority of players will understand that. But what about hentai? What's is the point of hentai, other than to entertain someone's carnal imaginations?

Carnality itself is not something that I am opposed to; as warm-blooded mammals, succumbing to it is natural. Thus I am not in favor of stopping hentai as a whole.

You see, my problem with loli hentai, on the other hand, is the fact that it entertains the viewer's carnal imagination through a child. A child is biologically and psychologically not supposed to be involved in such acts, and I believe that the amusement over such a depraved desire can be inspired by one's exposure to loli hentai.

Will the complete ban of loli hentai stop child pornography and prostitution from happening? I am sad to say that it probably won't. But I fully support it nonetheless, in that it will stop some cases from ever occuring.

I read the article. It's an anti-child pornography law that encompasses anime/cartoon as media. Basically, you're safe having legal age hentai such as Take on Me, but you'll prolly get jailed by having Boy's Empire.

Of course, this will raise the question "What is loli?"

Still, I'm pretty sure most of us here are safe unless something really, really stupid happens, like a door-to-door seizure of laptops and PCs, or they attempt to go China on us and set up The Great Firewall of Philippines. I'll only start being impressed if they can actually stop the pirated DVDs of child porn from getting sold on the streets, or track down the seedy film makers exploiting kids here in our country.
